# Terms and Conditions
The following Terms and Conditions apply to all bookings made on this website, including private airport transfers, point-to-point transfers and sightseeing tours operated by mycabit Ltd (“the Company”, “we”, “us”). Please take a moment to read them before making a booking.
By completing a booking on **mycabit.com** you confirm that you have read, understood and agreed to be bound by these Terms.

## 1. Definitions
In these Terms and Conditions the following definitions apply:
– **”Company”, “we”, “us”, “our”** means mycabit Ltd, a private limited company registered in the United Kingdom and trading under current British legislation.
– **”Customer”** means the person who pays for the Booking.
– **”Passengers”** means all passengers named and unnamed on the Booking.
– **”Lead Passenger”** means the first passenger named on the Booking.
– **”You” and “your”** means any customer, including all passengers (or any of them, as applicable) named on a Booking.
– **”Transport Operator”** means the licensed professional transport service provider who performs the Transfer or Tour.
– **”Booking”** means the booking for services made with us through our Website.
– **”Transfer Service”** means any point-to-point carriage of passengers by road, including airport transfers and station transfers, and any service incidental to that carriage.
– **”Tour Service”** means any chauffeur-driven sightseeing service of a fixed duration (e.g. 2-hour, 4-hour, 8-hour, multi-day) along a pre-published itinerary, operated by an English-speaking professional driver. Tour Services do not include the services of a tour guide.
– **”Service”** means a Transfer Service or a Tour Service, as applicable.
– **”Booking Confirmation”** means the written confirmation of the Booking we send to you by email after a successful payment.
– **”Contract”** means the Booking and these Terms, together with any other terms and conditions stated to apply to the Booking.
– **”Terms”** means these Terms and Conditions.
– **”Website”** means mycabit.com or any other website owned or operated by us.

## 2. About Us
mycabit Ltd provides transport management services for individuals and groups across Scotland, with a primary operating base in Edinburgh. We also trade as **”mycabit.com”**.
For all trading purposes we operate through the Website **mycabit.com**, with the email address **info@mycabit.com**. For the purpose of providing our Services, we work with licensed Transport Operators who deliver professional Transfer and Tour Services for transporting people, holding the relevant licences and permits required by UK national law.
Before requesting a Service offered on our Website you should ensure that you have read and understood these Terms, as they will govern any subsequent contract. By making a Booking you confirm that you have read these Terms and that you have the legal capacity to accept them on behalf of yourself and all the passengers. If you do not understand any of the contract conditions, we strongly recommend that you contact our Customer Service team before proceeding with any booking. If you do not wish to be bound by these Terms, regrettably you may not make a Booking with us.

## 3. Online Booking Procedure
The person making the Booking must be at least 18 years of age and has the responsibility to follow the online booking process, ensure all the details provided are correct and complete, and make full payment.
Upon entering into a contract with mycabit Ltd, the Company will undertake the necessary formalities to organise the requested Service.
The contract becomes legally binding only when you have received your **Booking Confirmation** by email. In the event that the Transport Operator is unable to provide the requested Service, you will be informed and refunded in full by the same method as the original payment, leaving us with no further liability to you.
You are required to acknowledge all notifications we make to you. However, in the event that you fail to acknowledge receipt of an email, the records that exist on our email server shall be considered as proof of reception.
The act of us sending you confirmation of charges and payments made shall not be considered as binding you to any contract until the Booking Confirmation has been issued.
A copy of your Booking Confirmation, displayed on a mobile device or printed out, should be readily available for the driver at the start of your Service. Failure by the Lead Passenger to present their Booking Confirmation may delay the start of the Service.
Minors are strictly prohibited from making a Booking with the Company. Parents, legal guardians or other persons responsible should contact us immediately should a minor make a Booking, in order to enable us to cancel the registration. Minors are not allowed to travel without an adult passenger in their company.

## 4. Payment
We accept payment by credit and debit card (Visa, Mastercard, American Express) through **Stripe**, our PCI-DSS Level 1 certified payment processor. Card details are entered directly on Stripe’s secure checkout — we never see or store your full card number.
For corporate accounts and bookings exceeding £1,000, bank transfer may be available on request by emailing info@mycabit.com.
All prices are charged in British Pounds Sterling (GBP). Any currency conversion display on the Website is provided as an approximation tool only; the amount actually debited from your card will be in GBP, and any conversion is performed by your bank or card issuer at their prevailing rate.
For sightseeing Tours, payment is taken in full at the time of booking unless otherwise stated. For Transfer Services, payment is taken in full at the time of booking, or as specified in your quotation email for custom requests. We do not currently store payment cards for future automatic charges; each Booking is paid separately.

## 5. Changes by the Customer
Your Booking Confirmation includes your requested pickup time, pickup address, destination and / or Tour itinerary. Any changes to these or any other details must be sent in writing by email to **info@mycabit.com** and will not take effect until checked with the Transport Operator and confirmed to you by email.
You are liable for any increased Service cost resulting from a requested change. The first change will be made free of charge; additional changes may incur a £15 administration fee.
Once the contract becomes legally binding, the Customer is requested to notify our Customer Service team of any errors not less than 36 hours prior to the corresponding Service. Notification made within 36 hours of the Service affords us the right to terminate the Contract without penalty or charge to either party.

## 6. Waiting Time
### 6.1 Airport collections (Transfer Services)
For journeys collecting from an airport, mycabit Ltd allows all passengers a maximum of 45 minutes from the time the flight actually lands to meet their driver. After this period, waiting time is charged regardless of reason, **from £10 per 15 minutes** of additional waiting time. The exact rate varies according to the vehicle category booked and is confirmed on your Booking Confirmation email. Payment is taken in cash to the driver, or added to your booking and charged to the card used at the time of booking.
We will honour requests for a “deferred” collection time (e.g. X minutes after flight landing). However, customers requesting this are not entitled to any additional waiting time beyond the requested period. No compensation will be offered if the passengers are ready earlier than planned and have to wait until the scheduled collection time for the driver to arrive.
Unless otherwise informed in writing in advance by email to info@mycabit.com, mycabit Ltd will assume a standard airport collection.
### 6.2 Other Transfer collections
Waiting time for non-airport Transfer journeys will be charged **from £10 per 15 minutes**, either from the scheduled collection time or for any unscheduled stop en route. The exact rate varies according to the vehicle category booked and is confirmed on your Booking Confirmation email.
### 6.3 Tour Services
Tour pickup times are confirmed at the time of booking. Tour Services have a strict departure time so that the full itinerary can be completed within the agreed duration. If the Lead Passenger is more than 15 minutes late at the agreed pickup address without prior notification, the Tour Service may be shortened proportionally or, in extreme cases, cancelled with no refund due. Please call our emergency line on **+44 7500 264020** if you anticipate being late.

## 7. Cancellations by You
All cancellations must be requested by email to **info@mycabit.com**. You will receive an email confirmation of the cancellation; if you do not receive a reply, please call our out-of-hours number on **+44 7500 264020** — we have not received your cancellation until we have confirmed it.
### 7.1 Transfer Services
– **More than 24 hours** before pickup: **£10 or 10% (whichever is higher)** + administration / transaction charge per journey, remainder refunded.
– **Within 24 hours** of pickup, or no-show: **No refund**.
– **Missed flights or Trains:** No refund**.
– **Flight cancellations: If a customer’s flight is cancelled by the airline and, as a result, the customer is unable to use the booked Transfer Service, the booking will be treated as a customer cancellation. Where the cancellation occurs within 24 hours of the scheduled pickup time, NO-REFUND will be due. Where the cancellation occurs more than 24 hours before the scheduled pickup time, the standard cancellation terms above will apply.
### 7.2 Tour Services
– **More than 24 hours** before the tour departure time: **£10 or 10% (whichever is higher)** + £10 Admin fee! + administration / transaction charge, remainder refunded.
– **Within 24 hours** of the tour departure time, or no-show: **No refund**.
Refunds will be issued via the original payment method (Stripe), and the funds will typically appear in your account within **5 to 10 working days**, depending on your card issuer.
Refunds will NOT be issued in the following circumstances:
– No-show for a pre-paid journey.
– Cancellation made outside the timeframes above.
– Customer-side change of mind regarding the published itinerary, vehicle type, or pickup address after the cut-off windows above.
– Forfeiture of an unused portion of a partially-completed Tour, where the cause is on the Customer’s side (late start, voluntary early departure, mid-tour withdrawal, etc.).
All other circumstances where a refund may be possible should be addressed directly with our customer service team.
**Flight cancellations: If a customer’s flight is cancelled by the airline and, as a result, the customer is unable to use the booked Transfer Service, the booking will be treated as a customer cancellation. Where the cancellation occurs within 24 hours of the scheduled pickup time, NO-REFUND will be due. Where the cancellation occurs more than 24 hours before the scheduled pickup time, the standard cancellation terms above will apply.

## 8. Last-Minute Bookings
Depending on the route and the season, our free-sale deadline varies from 0 to 48 hours before a Service commences (and more in exceptional cases). If a booking is permitted by the Website, our cancellation policies under Section 7 will apply regardless of how late the booking was made.

## 9. Changes and Cancellations by Us
If the Transport Operator needs to make a significant change to the conditions of the Service, or needs to cancel the Service, we will inform you as soon as possible.
We will use reasonable effort to honour your vehicle preference. However, the vehicle may be substituted with a vehicle of greater capacity, of an equivalent or higher class, or multiple vehicles, depending on availability. If we need to change your booking to a lower category or smaller vehicle for which a lower published rate applies, we will refund you the difference in rates.
In rare instances we may need to cancel your Booking. In such circumstances you will be refunded in full but we shall have no further liability arising out of such cancellation. We will, however, use all reasonable efforts to try and find suitable alternatives for any confirmed Booking subsequently cancelled by us.
Refunds for cancellations made by us will be issued within **3 working days** of the cancellation decision, and the funds will typically appear in your account within **5 to 10 working days** depending on your card issuer.

## 10. Child Seats
UK law regarding the use of child seats for infants and children must be complied with by all Transport Operators. For safety reasons, we recommend the use of booster, child or infant seats for children under the age of 12 or under 135 cm in height. During the booking process for Tours, you can pre-reserve infant, toddler and booster seats where available; for Transfer Services, please request child seats in advance by email or via the booking form.
The Lead Passenger must check, under their sole responsibility, that any child restraint device provided is suitable for the vehicle and is properly used and installed. The Company assumes no liability resulting from any failure to use, install, or check the restraint device, or resulting from its incorrect use.
If you wish to bring your own child or booster seat, please notify us in advance so that the vehicle can accommodate it.

## 11. Child Pricing
All children and infants count towards the seating capacity of the vehicle, regardless of age, and must be included in the total number of passengers at the time of booking. This is for safety reasons (every passenger must have a seat) and to allow the correct vehicle to be allocated.

## 12. Accessibility and Disabled Passengers
mycabit Ltd will make reasonable adjustments to accommodate passengers with disabilities or reduced mobility, in line with our duties under the **Equality Act 2010**.
### 12.1 Vehicle suitability — please read carefully
Our fleet consists of **standard saloon, MPV and 8-seater road vehicles**. We **do not currently operate wheelchair-accessible vehicles (WAVs)** with ramps, lifts or kneeling capability. As such, **passengers must be able to board and disembark the vehicle independently, or with the assistance of their own travelling party (carer, family member or companion)**.
Our drivers will assist with luggage and will provide reasonable verbal guidance during boarding, but for safety and insurance reasons our drivers **cannot physically lift, carry or transfer passengers** into or out of the vehicle.
If the passenger is unable to board a standard vehicle independently or with companion assistance, we strongly recommend that you contact us at **info@mycabit.com before booking** so we can advise on suitability or recommend an alternative provider with wheelchair-accessible vehicles.
### 12.2 Folding wheelchairs and mobility aids
We can carry **manual folding wheelchairs**, walking sticks, walkers and other portable mobility aids in the vehicle’s boot, subject to luggage capacity (see Section 16). **Motorised wheelchairs and mobility scooters cannot be accommodated.** Please advise us at the time of booking of any mobility aids you will be travelling with.
### 12.3 Notifying us in advance
To help us provide the best possible Service, please contact us at **info@mycabit.com** at the time of booking with details of:
– Any mobility aids you will be travelling with.
– Any specific needs at the pickup or drop-off location (kerb access, parking restrictions, etc.).
– Any animal accompanying the passenger (recognised assistance dogs are accommodated; please notify us in advance so we can allocate a suitable driver).

## 13. Pre-booked Extra Stops
During the booking process you may be given the opportunity to pre-book an extra stop, for example to collect keys or if your group is split between more than one accommodation address. The extra stop address must be located within the same destination area as your principal accommodation address. Extra-stop duration is limited to **5 minutes**.

## 14. Force Majeure
We accept no liability and will not pay compensation where the performance of our obligations or the Transport Operator’s obligations is prevented or affected, directly or indirectly, by force majeure or any circumstances beyond our reasonable control. This includes, but is not limited to:
– Extreme adverse weather conditions (heavy snow, flooding, named storms)
– Natural disasters
– Acts of terrorism
– Road traffic accidents on the route
– Police road closures or checkpoints
– Unusual traffic levels
– Industrial action
– Pandemic-related public health measures
– Failure of public infrastructure (power, telecommunications)
In such circumstances we will use reasonable efforts to provide an alternative Service, postpone the Service, or issue a refund.

## 15. Contact and Amendments
All contact related to the amendment of booking information must be requested by email to **info@mycabit.com**. The act of sending an email to your booking address is considered as proof of receipt by you; please therefore check that the email address provided at the time of booking is correct, and read all incoming emails up to the time of your Service.
If your arrival transportation is delayed or diverted to a different airport, station or port, the Transport Operator will reschedule the Service and you will be picked up at the new arrival time, subject to availability. In the case that there is no availability, you will be refunded in full. We apply IATA’s definition of flight delays for the purposes of these Terms.
If, for any reason other than a flight delay, you fail to be at the pickup point within a reasonable time after the scheduled collection time, the Transport Operator or our Customer Service team will attempt to contact you on the mobile number you provided. If you cannot be reached (no answer, voicemail, signal issues, incorrect number), the Service will not be provided, the Transport Operator is immediately relieved of their obligations and no refund will be due.

## 16. Baggage Allowance and Capacity
### 16.1 Transfer Services
Each passenger has a luggage entitlement of **1 large bag or suitcase** (maximum combined size 158 cm — length + width + height) plus reasonable hand luggage (handbag, small backpack). All large luggage items must be declared at the time of booking. Smaller items that fit in the passenger foot-well (camera bag, handbag, small shoulder bag) do not need to be declared.
The Passenger will be liable for all expenses incurred if additional vehicles are required to transport undeclared excess luggage.
All luggage must be securely labelled with the owner’s name and contact details. We cannot be held responsible for locating lost luggage that was not correctly labelled.
### 16.2 Tour Services
For sightseeing Tours, passengers should travel light: a daypack or small shoulder bag for personal items, water, camera and weatherproof clothing is appropriate. Large suitcases cannot be carried on Tour vehicles unless agreed in advance at the time of booking (e.g. for multi-day Tours that include hotel transfers).
### 16.3 Prohibited items (all Services)
You agree not to carry in your luggage, nor on your person:
– Firearms or other weapons
– Illegal substances or items prohibited under UK law
– Items likely to cause injury to other passengers or the driver
– Items of excessive size, weight, fragility or perishability without prior agreement
– Live animals, except for recognised assistance dogs notified in advance (see Section 12)
Transport of luggage and other personal belongings is undertaken **solely at your own risk** and under no circumstances can the Company be held responsible for any loss or damage. Such risk of loss or damage should be covered by your own personal travel insurance.

## 17. Your Responsibility
By entering into this Contract you implicitly declare that:
– You are of legal age (18+) and in full use of your mental faculties, enabling you to comply with all your legal responsibilities concerning this agreement.
– You are aware of the extent of the Services which are the object of this Contract, of the information about us, and of the content of these Terms.
– The credit or debit card you use belongs to you and has sufficient funds to cover the cost of the Service.
– You will notify us as soon as reasonably possible of any alteration to the contact or pickup details that you have provided.
– You are solely responsible for carrying all documentation necessary for any frontier crossing, where applicable. The Booking Confirmation is not a valid travel document.
We reserve the option not to accept future Bookings in the event of serious or repeated incidents involving any Customer.

## 18. Right of Admittance and Passenger Conduct
In entering into this Contract you accept that we and the Transport Operator have the right to refuse to transport any passenger who, at the driver’s discretion:
– May be under the influence of alcohol or drugs to a degree that, in the driver’s reasonable opinion, makes their presence in the vehicle unsafe or unmanageable;
– Behaves in a way that may be considered dangerous, threatening or abusive towards the driver, other passengers or themselves.
In our vehicles:
– **Alcohol consumption is prohibited.**
– **Smoking and vaping are forbidden** inside vehicles and in their immediate vicinity.
– **Eating and drinking inside the vehicle are not permitted**, with the sole exception of **sealed bottled water**. Hot drinks (coffee, tea), sugary drinks, alcoholic drinks and any sticky or staining beverages are not allowed at any time, due to spill, scald and upholstery damage risk. Comfort breaks during longer Tours include time at cafés and visitor centres where you can enjoy refreshments.
– **Narcotics are strictly prohibited.**
– Passengers must wear seatbelts at all times whilst the vehicle is in motion.
Where a Service is refused or terminated under this Section, no refund will be due and the Customer may be liable for any cleaning, repair or third-party costs arising from their conduct.
### 18.1 Vehicle damage and cleaning fees
If any passenger soils, spills on, or damages the vehicle interior — including (but not limited to) food, drink, mud, sand, sickness, ink, makeup, or burns — the Customer (Lead Passenger and / or cardholder) **authorises mycabit Ltd to recover** the applicable cleaning fee shown below, **either by charging the card used for the original booking, or by issuing an invoice** payable within 7 days:

| **Deep cleaning** — saturated upholstery, set-in stains, vehicle taken out of service for overnight valet | **£200** |
| **Specialist cleaning** — sickness, bodily fluids, biohazard, smoke / vape residue | **£300** |
| **Permanent damage** — replacement of upholstery, mats, seat trim, dashboard or other vehicle parts | **Actual repair / replacement cost + £50 administration fee** |
The driver will document any incident with photographs at the time it occurs. The Customer will be notified in writing of the fee within **7 working days** of the Service, together with supporting evidence. Disputes must be raised by reply within **14 days** of notification, after which the charge is deemed accepted and final.
Where a vehicle is taken out of service for cleaning, **loss-of-earnings** for the period of unavailability may also be claimed in cases of significant damage (calculated at the affected vehicle’s published hourly tour rate, capped at 24 hours).
### 18.2 Luggage handling and exterior damage
For the safety of passengers and the protection of the vehicle, **luggage will be loaded into and unloaded from the vehicle by the driver**. This is part of the standard Service and ensures correct weight distribution, secure stowage, and careful handling around painted surfaces, bumpers and trim.
Passengers should not attempt to load or unload luggage themselves unless specifically agreed with the driver. If a passenger insists on loading or unloading their own items against the driver’s advice, **any damage caused to the vehicle (interior or exterior) as a result is the Customer’s sole responsibility**.
The Customer must declare in advance any of the following, so that suitable protection or vehicle allocation can be arranged:
– **Hard-shell suitcases over 30 kg**, oversized trunks, or items with sharp / metal corners.
– **Sporting equipment** — bicycles, ski / snowboard bags, golf bags, surfboards, fishing rods.
– **Musical instruments**, large electronics, or items in rigid flight cases.
– **Pushchairs / prams** that do not fold compactly.
We reserve the right to **refuse to load any item** which, in the driver’s reasonable opinion, cannot be carried safely or without risk of damage to the vehicle. Where a passenger arrives with undeclared items of the type listed above, we may decline to carry them and no refund will be due.
The Customer will be liable for any damage to the **exterior** of the vehicle — including paintwork scratches, dents, scuffs to bumpers / panels, broken trim, damaged roof rails, scratched alloy wheels, broken aerials or mirrors — caused by:
– Loading or unloading carried out by the passenger or any third party in their party;
– Items belonging to the passenger striking the vehicle (e.g. bicycle pedals scraping bodywork, hard cases dropped onto bumpers, ski bindings on paintwork);
– Doors, boot or tailgate being closed forcefully or onto luggage by a passenger;
– Any other act or omission of a passenger that contributes to exterior damage.
The fee structure set out in **Section 18.1** applies equally to **exterior damage**, with **Permanent damage** charged at actual repair / replacement cost (parts, labour, courtesy car and re-spray) plus a **£50 administration fee**. The driver will photograph the affected area at the time of the incident, and the Customer will be notified in writing within **7 working days** as set out in Section 18.1.

## 19. Sightseeing Tours — Additional Terms
### 19.1 Itinerary and route flexibility
Our published Tour itineraries are indicative. Tour times listed for each stop are approximate. Stop durations, route order, and the exact mix of stops may be adjusted by the driver in response to local conditions, weather, opening hours of attractions, road closures, group preferences, or safety considerations. We reserve the right to substitute stops of similar or higher interest where the published stop is unavailable.
### 19.2 Admission tickets and attraction entry
Unless explicitly stated otherwise on the Tour page, the Tour price covers **vehicle, driver and the published route** only. **Admission tickets** to castles, distilleries, abbeys, museums, viewing platforms and similar paid attractions are **not included** and are the Customer’s responsibility, payable at the venue on the day.
### 19.3 Driver role
Our drivers are licensed professional **English-speaking chauffeurs**. They are not tour guides and do not provide narrated commentary, historical tours or on-site interpretation inside paid attractions. They will safely transport you between stops, share friendly local recommendations, and remain flexible to the group’s preferences within the published Tour duration.
### 19.4 Pickup and drop-off
Most Tours include **door-to-door pickup and drop-off** within central Edinburgh. Pickups outside this area may be available on request and may incur an additional charge — please contact us before booking. Pickups from accommodations with restricted access (private roads, pedestrian-only zones, bus-only streets) may need to be agreed at the nearest accessible point.
### 19.5 Tour duration
Tour duration is **measured from the scheduled pickup time** at your address. Late arrivals at the pickup point may shorten the effective Tour duration (see Section 6.3).
### 19.6 Group composition
Tour vehicles are **private to your group**; we do not seat unrelated parties together unless you explicitly request a shared tour. The maximum passenger count for each vehicle class is published on each Tour page; bookings exceeding the maximum require a custom quote.
### 19.7 Weather and seasonal variation
Scottish weather is highly variable. Tours operate in all weather conditions except where safety would be compromised (severe storms, road closures). Some viewpoints and outdoor stops may be less photogenic in poor weather; this is part of the Scottish adventure and is not grounds for a refund. We recommend bringing waterproof clothing year-round.
### 19.8 Multi-day Tours
For Tours of 2 days or more:
– Accommodation costs are **not included** unless explicitly stated on the Tour page.
– Customers are responsible for booking their own accommodation in the Tour’s overnight location, unless we have agreed otherwise in writing.
– A single-room supplement may apply for solo travellers on Tours where pricing is per-person.

## 20. Data Protection and Privacy (UK GDPR)
mycabit Ltd is the data controller for the personal data you provide during the booking process. We process your data on the lawful basis of **performance of a contract** (UK GDPR Article 6(1)(b)) and, where applicable, your **consent** for marketing communications (Article 6(1)(a)).
### 20.1 What we collect
– Name, email, phone number, pickup and destination addresses
– Payment authorisation data (processed and stored by Stripe; we do not store your full card number)
– Optional special-request information (child seat preferences, accessibility needs, etc.)
– Technical data (IP address, browser type) collected via the Website for security and analytics purposes
### 20.2 Why we keep it
– To deliver the Service you have booked
– To meet our legal obligations (tax records, dispute resolution)
– To improve our Service quality
– To send you transactional emails relating to your booking
### 20.3 How long we keep it
– Booking records: **7 years** (required for HMRC tax records)
– Marketing contact data: until you withdraw consent
– Technical/analytics data: up to 26 months in anonymised form
### 20.4 Your rights
Under UK GDPR you have the right to access, correct, delete, or restrict processing of your personal data, and the right to data portability. To exercise any of these rights, email **info@mycabit.com**. We aim to respond within 30 days.
### 20.5 Sharing
We share your data only with:
– The Transport Operator delivering your Service
– Stripe (for payment processing)
– Our hosting and email infrastructure providers under appropriate data-processing agreements
– Government authorities where legally required
We do **not** sell your personal data to third parties.

## 21. Cookies

## 22. Complaints
If the Service you receive does not meet your expectations, please report it to our Customer Service team **immediately** and, where possible, at the moment the issue occurs by calling **+44 7500 264020**. Complaints received after the Service has been completed and which were not brought to our attention at the time may not be upheld, as we were not given an opportunity to intervene or otherwise provide assistance.
Written complaints should be received **no later than 28 days** after your Service date and sent by email to **info@mycabit.com**.
We aim to acknowledge written complaints within **3 working days** and to provide a substantive response within **14 working days**.
If you remain dissatisfied with our resolution, you may be able to refer the matter to **alternative dispute resolution (ADR)** services available under UK consumer law.

## 23. Liability
Nothing in these Terms limits our liability for:
– Death or personal injury caused by our negligence;
– Fraud or fraudulent misrepresentation;
– Any other liability that cannot be limited or excluded by UK law.
Subject to the paragraph above, our maximum aggregate liability in respect of any Service shall not exceed the total amount paid by the Customer for that Service.
We are not liable for indirect, consequential or special losses, including (but not limited to) loss of profit, missed flights or connections caused by force majeure events (see Section 14), or third-party costs (separate ticket purchases, accommodation costs) that follow from a cancellation properly made under these Terms.

## 24. Governing Law and Jurisdiction
This Contract and any non-contractual obligations arising out of it shall be governed by and construed in accordance with the **laws of Scotland**. Any dispute arising out of or in connection with this Contract shall be subject to the **exclusive jurisdiction of the Scottish courts**, save that consumers resident elsewhere in the United Kingdom retain the right to bring proceedings in their local courts as permitted by UK consumer law.

## 25. Entire Agreement and Severability
These Terms (together with your Booking Confirmation, our published Tour itinerary at the time of booking, and any document expressly referred to in them) constitute the entire agreement between you and us. They supersede any previous agreement or representation between us, whether oral or in writing.
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable from the remainder of these Terms, which shall continue in full force and effect.
